Unlike demand letters or traditional debt collection, the use of "pre-action protocol legislation" means the debtor will either settle or be obliged to engage, making them respond long after they have stopped listening.
Debtor engagement promotes the concept of quick and economic justice and the settling of cases without proceedings, it also answers at an early stage "is the debtor worth pursuing?" where the issuing of proceedings is sought.
Where legal action is unavoidable it demonstrates best endeavours to the courts, reduces time to issue proceedings with use of default and summary judgments, and increases judgments in favour of claimant due to improved pre-action preparation and enhanced information, like the "Joint Evidence Pack" JEP®.
